Terms and Conditions

This Service Contract (“Service Contract”) is binding and constitutes its legal and regulatory effects between Tkfa, and all its subsidiaries, representatives, officials, directors, and third parties, hereinafter referred to as Tkfa, us, our, and between any individual who downloads Tkfa platform and benefits from its services, hereinafter referred to as the User. This Service Contract consists of two sections: the first includes the Terms and Conditions, and the second includes the Privacy Policy. All that is stated in this Service Contract governs and regulates the user’s use of Tkfa Platform, whether through its website or mobile application, hereinafter referred to as Tkfa Platform or the Platform. Tkfa Platform is an electronic platform that provides solutions to deliver users’ orders by enabling them to assign delivery couriers, hereinafter referred to as a Captain or Captains, to purchase/receive and deliver orders to and from the location specified by the user.
By accessing and using the services of Tkfa Platform, the User attests to and acknowledges that they have read, understood, and agreed to all that is stated in the Service Contract and that they are in full legal and mental capacity, which creates a contractual relationship between the User and Tkfa. In the event that they do not agree with all or part of what is stated in this Service Contract, they will not be permitted to use and access the services of Tkfa Platform. Tkfa may terminate this contract or any of the services related to it immediately, or in general stop providing its services, or prevent the user from accessing them partially or entirely at any time without the need to revert to the user.
Tkfa reserves the right to amend or update this Service Contract partially or entirely, such as but not limited to: the terms and conditions, adding/removing services, adding/ removing policies for specific events or specific promotions, customer reward programs, discounts, and promotions, or adding/ removing privacy policies, noting that the user will be notified upon any amendment or update to the Service Contract. Amendments are added to the Service Contract for the services provided, and thereof are considered part of the contract. The user’s continued access to or use of Tkfa Platform after the notice of modification and update constitutes their agreement to abide by the Service Contract as amended. Further, Tkfa reserves the right to amend any information on the pages referred to in the hyperlinks in this Service Contract from time to time. These modifications become effective upon publication. And the user’s continued access to and/or use of the services of Tkfa Platform after any such changes constitute their agreement to these adjustments.

1. TKFA Platform Services

TKFA provides an electronic bridge through its Platform between the user and the captains. Tkfa Platform enables users to meet their needs of purchasing products or receiving items, given that the value does not exceed five thousand Saudi Riyals per order. TKFA Platform allows captains to submit offers, which they deem appropriate to provide a delivery service to the user.
TKFA Platform provides the following electronic services:
1. Personal Stores and Restaurants Orders.
2. Personal Orders from Home-to-Home packages/items.

1. Personal Orders from Stores and Restaurants

Personal Orders from Stores and Restaurants within the User’s city

Through the personal orders from stores and restaurants service, the user may search and select the store or restaurant they intend to order from, describing what they intend to purchase and/or receive within their city limits, specifying the location of pickup and delivery, and selecting the method of payment, either by cash payment or electronic payment via one of the electronic payment options: Apple Pay, Mada, STC Pay, or credit cards, then sends the request through TKFA Platform, the captains then send their delivery fee offers, upon receiving the captains’ offers, the user has the option to accept or reject the provided offer. Upon accepting an offer, TKFA will enable the chatting feature between the user and the captain to facilitate communication on TKFA Platform. The chatting feature allows the user to amend the order described, provided that the amendments are done before the invoice is issued. Through the chatting feature, the user is given the possibility to add or modify the requests provided that the captain accepts this in writing on TKFA Platform, TKFA Platform also allows the feature to track the captain’s progress on the map, and the user may cancel the request without paying the cancellation fees within the first seven minutes of accepting the offer, provided that the captain has not issued an invoice for the purchases. If the invoice is issued, the user will not be able to cancel the order. When the captain arrives at the specified store or restaurant, they purchase and/or receive the product/item and send a copy of the store or restaurant’s invoice with the final price to the user. Tkfa Platform will automatically add the delivery fee, including value-added tax (VAT). If the user selects cash payment, they will pay in cash upon delivery. Whereas if the user chose an electronic payment method, they must pay online upon captain’s arrival. Upon order completion, Tkfa Platform will allow the user to rate the captain and service quality.

Personal Orders from Stores and Restaurants within the Kingdom of Saudi Arabia

The user may order using the personal orders from stores and restaurants service within the regions of the Kingdom of Saudi Arabia by:
1. Customizing notifications to receive announcements from captains intending to travel domestically within the Kingdom’s regions. Enabling the user to receive notifications only from the region they intend to purchase and/or receive orders from; or
2. Send a new request detailing their personal order from stores and restaurants within the Kingdom’s regions to the captains, if their orders were unavailable at the time on Tkfa Platform.
When one of the above options is selected, the user sends their request to the respective captains specifying the pickup and delivery location, describing the product/item, and selecting an electronic payment method from the available electronic payment options on the platform: Apple Pay, Mada, STC Pay, or credit cards. Accordingly, the captains will send their offers. If the user accepts the captain’s offer, Tkfa will enable the chatting feature between the user and the captain to facilitate communication on Tkfa Platform. The chatting feature allows the user to amend the described order, provided that it is done before the invoice is issued. The chatting feature enables the user to add or modify their request, provided that the captain accepts this in writing on Tkfa Platform. Tkfa Platform also enables the user the feature to track the captain’s progress on the map.
The user may cancel the order without paying the cancellation fees within the first seven minutes of accepting the offer, provided that the captain has not issued an invoice for the order. If the invoice is issued, the user will not be able to cancel the order. When the captain arrives at the store or restaurant, they must take a photo of the product/item and send it to the user with the final price as shown inside the store or restaurant. The user then receives a notification with the product/item’s photo and its final price. The user then may proceed to the purchase or withdraw from completing the order. If the user decides to proceed with the purchase, they must pay the full amount of the product/item in advance, including the delivery fees and value-added tax (VAT), through the selected electronic payment option on Tkfa Platform. After payment, the user will receive a unique four-digit-code on the Platform; the user must keep the unique code and not disclose it until the captain’s arrival to the delivery location.
After payment completion, the captain will then receive a notification stating that the user has prepaid, and they may safely complete the purchase of the product/item. When the captain purchases the product/item, the captain must send a copy of the store or restaurant’s invoice to the user. When the captain arrives at the delivery location, the captain must click on the “I arrived” option. The user then must share the unique four-digit-code with the captain to verify and confirm receipt. Upon order completion, Tkfa Platform will allow the user to rate the captain and service quality.

Personal International Orders from Stores and Restaurants

The user may order using the personal international orders from stores and restaurants service by:
1. Customizing notifications to receive announcements from captains intending to travel internationally. Enabling the user to receive notifications only from the locations they intend to purchase and/or receive orders from; or
2. Send a new request detailing their personal order from stores and restaurants located outside the Kingdom of Saudi Arabia to the captains, if their orders were unavailable at the time on Tkfa Platform.
When one of the above options is selected, the user sends their request to the respective captains specifying the pickup location in the specified country and delivery location within the Kingdom of Saudi Arabia, describing the product/item, and selecting an electronic payment method from the available electronic payment options on the platform: Apple Pay, Mada, STC Pay, or credit cards. Accordingly, the captains will send their offers. If the user accepts the captain’s offer, Tkfa will enable the chatting feature between the user and the captain to facilitate communication on Tkfa Platform. The chatting feature allows the user to amend the described order, provided that it is done before the invoice is issued. The chatting feature enables the user to add or modify the request, provided that the captain accepts this in writing on Tkfa Platform. Tkfa Platform also enables the user the feature to track the captain’s progress on the map. The user may cancel the order without paying the cancellation fee within the first fifteen minutes from the beginning of the captain’s journey to the store or restaurant as the user will receive a notification alert from the captain stating the “beginning of the journey”, provided that the captain has not issued an invoice for the order. If the invoice is issued, the user will not be able to cancel the order. When the captain arrives at the store or restaurant, they must take a photo of the product/item and send it to the user with the final price, as shown inside the store or restaurant. The user then receives a notification with the product/item’s photo and its final price. The user then may proceed to purchase or withdraw from completing the order. If the user decides to proceed with the purchase, they must pay the full amount of the product/item in advance, including all fees and taxes of which the product/item may be subject to in the country in which the store or restaurant is located, through the selected electronic payment option on Tkfa Platform. After payment, the user will receive a unique four-digit-code on the Platform; the user must keep the unique code and not disclose it until the captain’s arrival to the delivery location within the Kingdom of Saudi Arabia.
After payment completion, the captain will then receive a notification stating that the user has prepaid, and they may safely complete the purchase of the product/item. When the captain purchases the product/item, the captain must send a copy of the store or restaurant’s invoice to the user. When the captain arrives at the delivery location within the Kingdom of Saudi Arabia, the captain must click on the “I arrived” option. The user must then share the unique four-digit-code with the captain to verify and confirm receipt. Upon order completion, Tkfa Platform will allow the user to rate the captain and service quality.

2. Personal Orders from Home-to-Home.

Personal Orders from Home-to-Home within User’s City

Through the personal orders from home-to-home within the user’s city, the user specifies the pickup and delivery location within their city limits, then describes what they intend to purchase and/or receive, and selects the payment method, either cash payment or payment via one of the electronic payment options: Apple Pay, Mada, STC Pay, or credit cards, then sends the request through TKFA Platform. The captains then send their delivery fee offers, upon receiving the captains’ offers, the user has the option to accept or reject the provided offer. Upon accepting an offer, TKFA will enable the chatting feature between the user and the captain to facilitate the communication on TKFA Platform. The chatting feature allows the user to amend the order described, provided that it is done before the invoice is issued. Through the chatting feature, the user is given the possibility of adding or modifying the request provided that the captain accepts this in writing on TKFA Platform, TKFA Platform also allows the feature to track the captain’s progress on the map.
The user may cancel the request without paying the cancellation fees within the first seven minutes of accepting the offer, provided that the captain has not issued an invoice for the purchases. If the invoice is issued, the user will not be able to cancel the order.
When the captain arrives at the specified pickup location, the captain must send a photo of the product/item to the user for verification; upon the user’s confirmation, the captain makes the purchase and/or receive the product/item. Upon captain’s arrival at the delivery location, the captain must issue an electronic invoice by manually entering the delivery fees. TKFA Platform will automatically add the value-added tax (VAT). If the user selects cash payment, they will pay in cash upon delivery. Whereas if the user selected an electronic payment method, they would receive a unique four-digit-code upon electronic payment completion; the user must only share the code upon captain’s arrival to the delivery location to verify and confirm receipt. Upon order completion, Tkfa Platform will allow the user to rate the captain and service quality.

Personal Orders from Home-to-Home within the Kingdom of Saudi Arabia

The user may order using the personal orders from home-to-home within the Kingdom of Saudi Arabia by:
1. Customizing notifications to receive announcements from captains intending to travel domestically within the Kingdom’s regions. Enabling the user to receive notifications only from the region they intend to purchase and/or receive orders from; or
2. Send a new request detailing their personal order from a home within the Kingdom’s regions to the captains, if their orders were unavailable at the time on Tkfa Platform.
When one of the above options is selected, the user sends their request to the respective captains specifying the pickup and delivery location, describing the product/item, and selecting the payment method either by cash payment or via one of the electronic payment options available on the platform: Apple Pay, Mada, STC Pay, or credit cards. Accordingly, the captains will send their offers. If the user accepts the captain’s offer, Tkfa will enable the chatting feature between the user and the captain to facilitate communication on Tkfa Platform. 2. Terms of Use of Tkfa Platform

2.1. User Account

To use the services of Tkfa Platform, the user must create an active personal account on the platform (“The Account”). The user must be at least 17 years old to create an account on Tkfa Platform. Account registration requires submitting certain personal information such as the name, address, mobile number, age, and e-mail. The user agrees to enter their information and ensure that it is updated regularly and accurately in their account, and they acknowledge and attest to its validity. The user’s failure to update their personal account information may lead to the inability to access or use the services of Tkfa Platform. The user is responsible for all activities that occur under their registered account, and they agree to maintain the security and confidentiality of their account username and password at all times. The user may not have more than one account on Tkfa Platform.

2.2. Service Contract Validity

This Service Contract shall remain in effect for the complete duration of the user’s personal account activity unless the user deactivates their account on Tkfa Platform by following the official account deactivation procedures. The user has the right to deactivate their account at any time and permanently delete the platform installed on their smartphone; by doing so, the user will be unable to access Tkfa Platform and its services.
Tkfa has the right to terminate the contract immediately and at any time without reverting to the user by deactivating the user’s account, which disables the user from accessing the services of Tkfa Platform if the user violates any of the terms stated in this Service Contract or if the user does not agree to the updates and amendments that may occur from time to time on the terms of this Service Contract. Tkfa has the right to decide to deactivate and close Tkfa Platform at any time without the need to revert to the user.

2.3. User Requirements

The services of Tkfa Platform are not available for those under the age of 17 years. The user is not entitled to authorize their account to other parties, and the user cannot allow persons under the age of 17 to access delivery services using Tkfa Platform. The user may also not assign their account or transfer its ownership to any other person or entity. The user agrees and is obligated to comply with all enforceable laws and regulations within the Kingdom of Saudi Arabia when using Tkfa Platform. The user may not use the platform except for legal and regulatory purposes that do not conflict with Islamic Sharia and local traditions, such as requesting prohibited or dangerous materials that will be specified in paragraph (2,4. Prohibited Conduct). The user may not cause injury, damage, inconvenience, harassment, or commit any harm of any kind to others while using the services of the platform, whether to captains, stores, restaurants, or any other parties. Under Tkfa’s sole discretion, the user may be required to provide proof of identity for access purposes or while using the services of Tkfa Platform. The user agrees that they may be prevented from accessing, using, or completing the platform services if they refuse to prove identity.

2.4. Prohibited Conduct

When using the services of Tkfa Platform, the user acknowledges that they are prohibited from conducting the following:
1. Impersonating any person or entity.
2. Harming any person or entity, whether by harassment, abuse, stalking, threatening, or carrying any weapons or prohibited dangerous materials.
3. Violating any law, regulation, or Islamic Shariah, or the customs and traditions prevailing in the Kingdom of Saudi Arabia.
4. Damaging and/or disrupting Tkfa Platform in any way directly or indirectly, or any of its servers and networks.
5. Posting, sending e-mails, or transmitting any instructions, software instructions, files, or malware developed to disrupt, destroy, erase, or limit the functions of Tkfa Platform or any computer program, device or communications equipment, or intercept or confiscate any system, data or information. Stealthily and illegally.
6. Interacting and/or posting information on Tkfa Platform in a fraudulent, defamatory, abusive, obscene, vulgar, racist, or sexual orientation.
7. Using Tkfa Platform in any way that violates the rights of any third party, including intellectual property rights, copyrights, patents, trademarks, trade secrets, other proprietary rights, rights of publicity or privacy.
8. Cyber phishing and/or copying and/or falsifying any part of Tkfa or the Platform, without obtaining prior written permission from the platform or using the trademark, promotional codes, or other files, programs, and devices that contain any reference to Tkfa or the platform; by committing fraud, or deceiving people, or directing them to any other platform, or stealing their information;
9. Transferring and/or selling the user account, password, or any other user information to any other party.
10. Discriminating or harassing anyone based on race, national origin, religion, gender, physical or mental disability, medical condition, marital status, age, or sexual orientation.
11. Causing any third party to engage in prohibited activities through Tkfa Platform.
12. Using Tkfa Platform to purchase prohibited and/or illegal products/items under the Kingdom of Saudi Arabia laws and regulations. Such as but not limited to, purchasing alcoholic beverages of all kinds, purchasing all sorts of drugs, and purchasing pornography of all types. Tkfa Platform also prohibits purchasing illegal products/items, as specified in the banned and restricted goods for individuals issued by the Saudi Customs.

Prohibited Products/Items

Banned animals, dangerous animal species and/or materials derived from them

1. Endangered animals.
2. Animals banned in the Kingdom of Saudi Arabia.
3. Dogs whose entry and exchange is restricted in the Kingdom of Saudi Arabia.
4. Pork, its meat, fat, hair, blood, guts, and all that is extracted from it.
5. Frog meat.
6. Mummified animals.
7. Veterinary vaccinations.
8. Animal parts, blood, or other fluids derived from it, including food items that are used in animal blood.
9. Animals that are prohibited by law in the Kingdom of Saudi Arabia to trade with them.

Alcoholic and spiritual drinks

1. Alcoholic wines and alcohol of all kinds.
2. Spiritual drinks of all kinds.
3. Any drink bearing the name Zamzam from an unknown source.

Drugs and medications

1. Drugs of all kinds and forms.
2. Prohibited human drugs according to the Ministry of Health in the Kingdom of Saudi Arabia.
3. Equipment for preparing drugs and medicines.
4. Herbal substances such as plants and herbs that are prohibited to use by digestion, inhalation or extraction from any other illegal substances that have the same effect as prohibited drugs.
5. Illegal materials claiming health benefits without official documented evidence.

Pornography

1. Pornography of all kinds.
2. Materials that may be sexually exploited by children.

Weapons, security agencies, and the like

1. Weapons, security, and military agencies of all kinds.
2. Pistols and rifles of all kinds.
3. White arm weapons such as knives and daggers.
4. Gunpowder, bombs, explosives, safety wicks, and ignition or detonation capsules.
5. Ammunition.
6. Spyware, and security vehicle radar detection devices.

Prohibited games

1. Tools, machines, and devices for gambling of all kinds, including, but not limited to, lottery tickets and betting cards.
2. Fireworks that are used by children, such as but not limited to rockets, and flash matches.
3. Violent and dangerous electronic games.
4. Spyware games.

Papers and cards

1. Counterfeit currencies, papers, and securities.
2. Blank invoices addressing the names of foreign companies abroad.
3. Quran for commercial purposes.

Waste

Industrial waste and hazardous waste:
1. Waste of pharmaceutical preparations.
2. Waste of the chemical industries and allied industries.
3. Municipal waste.
4. Sewer waste.

Fertilizers and agricultural materials

1. Raw natural organic fertilizers obtained from animal or vegetable origin.
2. Weeds and seeds prohibited according to the regulations of the Kingdom of Saudi Arabia.
3. Chemical agricultural fertilizers.

Human organs

Human organs and/or any part of the human body including blood, fluids, stem cells, and embryos.

The user acknowledges that they will become personally liable and will have to answer any claim brought by law enforcement or any third party for committing any infringement on the prohibited conduct specified in paragraph 2.4 of this Service Contract through Tkfa Platform. Furthermore, Tkfa reserves the right to claim compensation from the user in court for any damage caused by the user for such misconduct.

2.5. Communication

Using Tkfa Platform, the user agrees and consents to communicate with the platform, including email correspondence, calls, and instant alerts. The user agrees and consents that Tkfa may generate texts, calls, or pre-recorded messages using automatic telephony and automated communication systems. The user also agrees to communicate with the platform, the captain, and its affiliates, including but not limited to: operational communications related to the user’s account and communications related to promotional offers administered by the platform. The user also agrees and acknowledges that all communication, telecommunications, and correspondence are recorded and saved with Tkfa. All communication materials, telecommunication, audio, video, and written correspondence between the user and Tkfa are conclusive and final proof in the event of any dispute.

2.6. Text Messages

Upon creating a user account, the user agrees and consents to Tkfa sending informational text messages as part of the daily business context to use the platform’s services. The user has the right to refuse to receive text messages from Tkfa at any time by sending a request to the e-mail: support@tkfa.com indicating that they do not wish to receive further text messages on their registered mobile number. The user acknowledges that their refusal to receive such text messages may affect their use of the platform’s services. The standard text messaging fees imposed by the user’s mobile network and internet operator will apply to Tkfa’s text messages.

3. User-generated Content

Tkfa has the right and sole discretion to allow the user from time to time to submit, upload, publish or provide text and/or audio and/or visual content and information on Tkfa Platform through the platform services and/or any other platforms. These include social networking sites, text messages, and e-mails, including comments and inputs related to services, creation of support requests, and re-posting of promotional offers, all included under (“User Content”). Any content created by the user remains the property of Tkfa. By submitting user-generated content on Tkfa Platform or other platforms through Tkfa Platform, the user grants Tkfa a permanent, irrevocable, domestic, and international license whose privileges are nontransferable to their user-generated content. The user also gives Tkfa the right to sublicense, use and copy the content, modify it, derivative works from it, distribute it, display it, perform it, and use it in any way publicly or privately. Further, Tkfa may use the content and publish it on all distribution channels, whether they are currently known or established in the future, without reverting to the user or obtaining approval from them and without the need to pay them or any other person or entity.
The user is solely responsible for the content they provide on Tkfa Platform, whether text, audio, or visual. The user acknowledges and contests not to submit or post any user content that is defamatory, abusive, violent, obscene, pornographic, racist, illegal, or offensive in any form and is known later as (Inappropriate Content). The user acknowledges that Tkfa has the absolute right to delete any inappropriate content, whether this content is protected or unprotected by law. The user is solely responsible before the relevant authorities in the event of any complaint or claim associated with the user’s inappropriate content. Tkfa may review, monitor, or remove user content at its absolute discretion at any time and for any reason without reverting to the user.

 

4. Accessing Network and Devices

The user is responsible for obtaining the necessary data to access the internet to use the services of Tkfa Platform. Network providers may impose charges for the use of internet data and messages; the user is responsible for such costs according to their subscribed or activated packages. If the user uses a wireless device, the user is responsible for the prices and fees applied to wireless device services. The user is also responsible for owning and updating the appropriate devices necessary to access the services of Tkfa Platform, and any updates or modifications related to their devices and its use. Tkfa does not guarantee in any way that its services, or any part thereof, will operate on any devices of certain types or specifications. Furthermore, the platform services may experience malfunctions and delays related to the use of the internet and electronic communications. Therefore, Tkfa is not responsible for such faults and delays.

5. Fees and Payment

The user understands and acknowledges that by using Tkfa Platform’s services, they will be subject to certain charges. Tkfa reserve the right to set fees and prices and the right to amend them at its sole discretion. Fees will include applicable taxes as stipulated by the laws and regulations of the Kingdom of Saudi Arabia. All fees paid by the user shall be final and non-refundable unless Tkfa specifies otherwise. Fees and prices may differ depending on the type of service required. Such as, but not limited to domestic delivery services fees will vary from international delivery service fees. The user also acknowledges that fees and prices on the platform services may significantly increase in some geographical areas during high demand times (AKA rush hours). The user may cancel their request within the first seven minutes of accepting the captain’s offer in domestic orders, provided that the captain has not issued an invoice. If the user cancels their request after the first seven minutes, then Tkfa will impose a cancellation fee of 20% of the delivery fee on the user’s account on the platform, and if an invoice is issued before the first seven minutes of accepting the captain’s offer or after it has passed, the user will not be allowed to cancel the order. The user may cancel the order without paying the cancellation fee within the first fifteen minutes of the captain’s arrival at the specified store or restaurant in international orders. If the user wishes to cancel the order after the first fifteen minutes have passed from the captain’s arrival at the specified store or restaurant in international orders, Tkfa will impose a cancellation fee of 30% of the delivery fees the user’s account on the platform. The user is not allowed to cancel their order if an invoice is issued in international orders. The user also acknowledges that Tkfa is not responsible for any additional amounts paid to Captains outside the platform, such as tips, which are paid by the user voluntarily. The user is responsible for reviewing the fees and pricing policies of Tkfa regularly, and the user is responsible for all fees incurred under their user’s account regardless of their awareness of these fees or the amounts related to them. Tkfa has the right to ask the user to pay any amounts owed in their account at any time. All paid fees are handled by a third party that works on processing and verifying payments for Tkfa Platform. Such as, but not limited to, Apple Pay, Mada, STC Pay, or credit cards, and Tkfa may adjust its third parties by addition or removal without reverting to the user. The user must pay the fees only through Tkfa Platform, except for tips.
The user shall meet all their obligations towards Tkfa by paying the fees of using the platform’s services. The user may review their orders history and check receipts and payments. The user acknowledges that Tkfa may use their credit card for authorization purposes, when adding a new payment method or requesting further services. Tkfa may request authorization for a specified payment method to verify the payment’s validity and ensure that service fees are covered. Authorization is not a fee; however, it may reduce your available balance by the amount of the authorization until the next processing cycle, according to the user’s bank.

6. Marketing

The user agrees that Tkfa reserves the sole right to market and advertise various promotional materials within the platform at its absolute discretion. Promotional materials include but are not limited to promotions and advertisements of retail stores and restaurants, entertainment centers, malls, marketing campaigns for specific events, social awareness campaigns, public service messages, and community and government campaigns. The user also acknowledges and agrees that Tkfa reserves the right to decide the content of the advertising and promotional materials promoted within the platform. The user has no right to interfere with the content of promotional and advertisement materials, nor the right to illegally use or exploit it.

7. Promotional Codes, Offers, Discounts, Referral and Customer Reward Programs

Tkfa may, at its absolute discretion, create promotional codes (“Promotional Codes)” that may be redeemed and added to the user’s account, or add and retrieve some features or other benefits related to the platform’s services, as specified by Tkfa regarding each promotional code on the platform. The user agrees that promotional codes:
1. Must be used lawfully for its intended audience and purpose.
2. May not be copied, sold, or transferred in any way, or made available to the public. Whether it was published on a public form or contrarily unless otherwise stated by Tkfa.
3. Maybe disabled by Tkfa at any time for any reason without incurring any legal liability.
4. May only be used under the special conditions set by Tkfa for each promotional code.
5. Not convertible to cash payment.
6. May expire before the user redeems it.
Tkfa reserves the right to withdraw or deduct the added credits, benefits, or other benefits that were obtained through the use of the promotional codes by the user or by any other user; if the use or redemption of the promotional codes proved to be mistaken, fraudulent, illegal, or in violation of the terms of the promotional codes stated in this Service Contract.
Tkfa may, at its absolute discretion, make promotional codes, offers, discounts, referral, and customer reward programs available to any user or potential users. Promotions and programs will not affect this Service Contract. Tkfa reserves the right to withhold or deduct the credits or benefits obtained through a promotional offer or program if proven to Tkfa that the redemption of the promotion or the receipt of credit was mistaken, fraudulent, illegal, or violated a promotion condition. Tkfa reserves the right to terminate, suspend, or cancel any promotions, discounts, referral, or customer reward programs at any time without reverting thereof to the user.

 

8. Intellectual Property Rights

Tkfa entirely owns all intellectual property rights within Tkfa Platform. These rights include database rights, copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered), and any other similar rights withholding the right to apply for its protection at any time. All trademarks, logos, company names, or other product names mentioned on Tkfa Platform are their respective owners’ property. The user acknowledges and agrees that any questions, comments, suggestions, ideas, notes, or other information such as what the user sends to the platform through correspondence and communication is not confidential and will become the exclusive property of Tkfa. Tkfa owns the exclusive rights, including all intellectual property rights. Tkfa is entitled to the unrestricted right to use and publish these materials provided for any purpose, commercial or non-commercial, without reverting to the user for approval or compensation.
Tkfa, Tkfa Platform, its logos, designs, graphics, icons, texts, names of its services, and any commercial appearance are trademarks registered with Tkfa in the Kingdom of Saudi Arabia. The use of the Tkfa logo, Tkfa Platform, or any of its trademarks or commercial appearances is not permissible without written permission issued by the board of directors of the company that owns Tkfa LLC, which operates Tkfa Platform. It is also not permitted to use Tkfa signs or Tkfa’s commercial platform and its manifestations in a manner that misleads others, including but not limited to: the use of the Tkfa’s trademark or Tkfa Platform as a domain name for a website or a referral code, or its use as a name, symbolic name, profile picture, symbol, or banner.
